Welcome to TapTally. TapTally provides a platform where local businesses can create digital loyalty cards, QR/NFC enrollment flows, tap-to-stamp workflows, customer reward pages, and owner dashboards.

Contract Summary

These Terms form an agreement between you and Lexom Inc. ("Lexom", "TapTally", "we", "us", or "our"). If you use TapTally on behalf of a business, you confirm you are authorized to bind that business. If you do not agree to these Terms, do not use TapTally.

Businesses own offers

Businesses configure rewards and are responsible for honoring their own loyalty offers.

TapTally runs tools

We provide the platform, portal, links, dashboards, support, and related services.

Subscriptions renew

Paid plans may renew automatically unless cancelled according to the billing rules below.

Acceptance of Terms

By accessing or using TapTally, creating an account, joining a loyalty program, using portal.taptally.ca, opening a go.taptally.ca customer link, or purchasing a subscription, you agree to these Terms and our Privacy Policy.

These Terms apply to business owners, staff users, customers participating in loyalty programs, and anyone else who accesses TapTally.

Platform Summary

TapTally helps businesses create loyalty programs and customer reward experiences. We are a software provider. We are not a party to the sale of goods or services between a business and its customers.

Businesses are responsible for the accuracy, legality, availability, cancellation rules, limitations, taxes, and fulfillment of any reward, promotion, perk, or loyalty offer they publish or operate through TapTally.

Accounts and Access

  • You must provide accurate account information and keep it current.
  • You are responsible for keeping login credentials secure and for activity under your account.
  • Business accounts should grant staff access only to people who need it.
  • We may require business verification, identity, ownership, or billing information before enabling some features.
  • Customers may need to provide a phone number, email, code, or other identifier to join or recover a loyalty card.

Loyalty Programs and Customer Offers

Businesses must clearly describe their loyalty programs, reward rules, expiry terms, redemption conditions, participating locations, and any limits or exclusions. Businesses must not use TapTally for discriminatory, misleading, unlawful, unsafe, or abusive offers.

Customers should review the business-specific loyalty rules before relying on a reward. TapTally may remove or suspend a loyalty program if we believe it is unlawful, misleading, abusive, technically harmful, or inconsistent with these Terms.

Subscription Terms

These Subscription Terms ("Sub Terms") govern your purchase and use of paid, auto-renewable subscriptions to access premium features in TapTally ("Service"), operated by Lexom Inc. ("Lexom", "TapTally", "we", "us", "our"). By purchasing or renewing a subscription, you agree to these Sub Terms, our Terms and Conditions, and our Privacy Policy. If you do not agree, do not purchase or use any paid subscription.

  • Subscription plans, features, limits, fees, billing cycles, taxes, and trial periods will be shown on TapTally or in your account before purchase where applicable.
  • Subscriptions renew automatically unless cancelled before the next billing period according to the cancellation process shown in the portal or by the payment processor.
  • Plan upgrades may take effect immediately and may be charged on a prorated basis. Downgrades may take effect at the next billing cycle.
  • If payment fails, we may retry the payment, request updated payment details, limit features, suspend access, or cancel the subscription.
  • Except where required by law or expressly stated by TapTally, subscription fees are not refundable for change of mind, unused time, or business circumstances outside TapTally's control.

Payments, Taxes, and Billing

You must pay all fees when due and use only lawful, authorized payment methods. You are responsible for applicable sales taxes, value-added taxes, withholding taxes, payment processor fees, and other amounts associated with your use of TapTally unless the law requires us to collect or remit them.

We may change pricing, plans, or included features with notice where required. If you do not agree with a pricing change, your remedy is to cancel before the change applies.

Acceptable Use

  • Do not use TapTally in a way that violates law, infringes rights, misleads customers, or creates civil or criminal liability.
  • Do not interfere with TapTally, scrape it, reverse engineer it, overload it, bypass access controls, or introduce malware.
  • Do not upload personal information unless you have the right to do so.
  • Do not manipulate stamps, rewards, customer data, analytics, billing, or business verification.
  • Do not use TapTally to send spam or unsolicited electronic messages in violation of Canadian anti-spam or other marketing laws.

Data, Privacy, and Confidentiality

Our Privacy Policy explains how we handle personal information. Each party may receive confidential information from the other and must protect it using reasonable care.

Businesses remain responsible for their own customer relationships, privacy notices, consent practices, marketing compliance, and use of exported or copied customer data.

SMS Verification Messages

If you provide your phone number during owner portal onboarding and choose to receive verification texts, you agree that TapTally may send automated SMS messages for onboarding phone verification and account security. Message frequency varies based on onboarding and account verification activity. Carrier message and data rates may apply.

Reply HELP for help or STOP to stop receiving verification texts. Consent to receive SMS messages is not required to make a purchase. If you opt out of verification texts, onboarding, account access, or recovery features may not work until another verification method is available or you opt back in.

Intellectual Property

TapTally, including its software, interfaces, brand, designs, code, content, documentation, and platform features, is owned by Lexom Inc. or its licensors. You receive only the limited right to use TapTally according to these Terms.

Businesses retain ownership of their business names, logos, uploaded content, and loyalty program details. You grant us the rights needed to host, display, process, back up, analyze, and transmit that content to provide TapTally.

Beta Features and Availability

TapTally is early-stage. Features, pricing, integrations, domains, templates, analytics, QR/NFC flows, and portal behavior may change as the product is validated with businesses.

We try to keep TapTally available, but we do not guarantee uninterrupted or error-free service. Downtime may happen because of maintenance, bugs, internet issues, third-party providers, security incidents, or events outside our reasonable control.

Cancellation, Suspension, and Termination

You may stop using TapTally or cancel a paid subscription through the account or billing process made available to you. Cancelling a subscription does not automatically delete your account or all data.

We may suspend or terminate access if you breach these Terms, fail to pay fees, misuse TapTally, create risk for customers or businesses, violate law, or create security or operational issues.

Disclaimers

TapTally is provided "as is" and "as available" to the fullest extent permitted by law. We do not guarantee that TapTally will increase revenue, customer retention, repeat visits, redemption rates, customer satisfaction, or business outcomes.

Businesses are solely responsible for customer service, product quality, offer fulfillment, tax compliance, and any disputes with customers about rewards or promotions.

Limitation of Liability

To the fullest extent permitted by applicable law, Lexom Inc. and its directors, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of goodwill, data, business, or revenue.

To the fullest extent permitted by law, our total aggregate liability for claims arising from or relating to TapTally or these Terms will not exceed the greater of the amount you paid to TapTally in the 12 months before the claim or CAD $100.

Consumer and Mandatory Legal Rights

Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under applicable Canadian federal or provincial consumer protection, privacy, competition, or other mandatory laws.

If any part of these Terms is unenforceable, the remaining terms continue to apply to the maximum extent permitted by law.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Lexom Inc. from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of TapTally, your breach of these Terms, your loyalty offers, your customer disputes, your uploaded content, or your violation of law or third-party rights.

Governing Law and Disputes

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. The courts located in Ontario will have exclusive jurisdiction, except where mandatory law gives you another right.

Changes and Contact

We may update these Terms as TapTally evolves. The updated version will be posted on this page with a new last-updated date. Continued use after changes means you accept the updated Terms.
